Article 2 – Applicability
These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and a consumer.
Before the agreement is concluded, the text of these Terms and Conditions will be made available to the consumer in such a way that it can be stored on a durable data carrier.
Article 3 – The Offer and the Agreement
The offer contains a clear description of the products and/or services offered. Obvious errors or mistakes are not binding on the entrepreneur.
The agreement is concluded at the moment the consumer accepts the offer and complies with the stated conditions (such as successfully completing payment).
After placing an order, the consumer will receive a confirmation email. Until this confirmation has been sent, the consumer may cancel the order.
Article 4 – Prices and Additional Costs
All prices on the website are listed in euros and exclude any import VAT and customs clearance fees.
Products are shipped from outside the European Union. This means that the postal or courier service may charge import VAT and/or customs clearance fees upon delivery. These costs are entirely the responsibility of the consumer.
The entrepreneur does not charge Dutch or Belgian VAT on purchases.
Any shipping costs will be clearly stated before completing the order.
Article 5 – Payment
Payment must be made via the payment methods offered on the website and must be completed immediately upon placing the order.
The consumer is responsible for providing accurate and complete payment and contact details.
Article 6 – Delivery
The entrepreneur will exercise the greatest possible care in processing and delivering orders.
Orders will be processed and shipped as quickly as possible, unless stated otherwise. Delivery times are indicative and do not entitle the consumer to compensation.
The risk of loss or damage to products transfers to the consumer at the moment of delivery to the address provided by the consumer.
Article 7 – Right of Withdrawal (14 Days)
The consumer has the right to withdraw from the agreement within 14 days of receiving the product, without giving any reason.
Within this period, the consumer must notify the withdrawal by email to contact@luchique.nl. After notification, the consumer has an additional 14 days to return the product.
During the withdrawal period, the consumer must handle the product with care. The product may only be unpacked or used to the extent necessary to determine its nature, characteristics, and functioning.
The consumer is responsible for return shipping and the associated costs. The entrepreneur may charge for any depreciation in value if the product has been used beyond what is necessary.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal is excluded for, among others:
- Products that cannot be returned for hygiene reasons once the seal has been broken (such as underwear, lingerie, and certain personal care products)
- Products made to the consumer’s specifications or clearly personalized
- Products that cannot be returned due to their nature
If the right of withdrawal is excluded, this will be clearly stated on the product page and during the ordering process.
Article 9 – Conformity and Warranty
The entrepreneur guarantees that the delivered products comply with the agreement and meet the reasonable expectations of the consumer.
Any visible defects or incorrectly delivered products must be reported as soon as possible, but no later than 14 days after delivery, via email.
If a product is demonstrably defective, the entrepreneur will reasonably provide a replacement, repair, or refund.
Article 10 – Complaints
Complaints regarding the performance of the agreement must be submitted within a reasonable time, clearly and fully described, via contact@luchique.nl.
The entrepreneur will respond as quickly as possible, but no later than 14 days after receipt. If a complaint requires a longer processing time, the consumer will receive a confirmation within 14 days along with an indication of the expected response time.
Article 11 – Liability
The entrepreneur is not liable for indirect damage, consequential damage, or loss of profit.
In all cases, the total liability of the entrepreneur is limited to the amount of the relevant order, unless mandatory law provides otherwise.
Article 12 – Applicable Law
These Terms and Conditions and all agreements between the entrepreneur and the consumer are exclusively governed by Dutch law, even if the consumer resides abroad.
